Restructuring & Creation of Positions

1. What are the differences between Contract for Service (CFS) and Contract of Service (COS)?

Contract of Service (COS)

COS adopts the service schemes, grades and salary rates specified for public service. Two (2) types of provisions adopted for the payment method are:

  • OS11000 provision - Contract appointments under OS11000 provision adopt the existing posts. Recruitment is subject to the Appointing Authority, such as the common-users service schemes implemented by the Service Division of the Public Service Department (PSD).

  • OS29000 provision - Contract appointments under OS29000 provision do not adopt the existing posts, but the appointments are based on the schemes of service, job grades and salary rates used in public service. Appointments under OS29000 provision must be referred to the Establishment and Organisation Division (BPO), PSD for consideration.

Contract For Service (CFS)

CFS does not adopt any schemes of service, job grades and salary rates specified for public service. CFS appointments should be applied from the Ministry of Finance to set specific terms of service.

2. What are the differences between Restructuring, Establishment Strengthening & Establishment of a New Agency Studies?
  1. Organisational Restructuring study is a study involving changes to the existing organisational structure of an agency. This study requires an application involving the Organisational Strategic Plan or a Rebranding Plan of the agency. The study also involves changes to the activities/programmes in the establishment warrant.
  2. Establishment Strengthening study is a study involving the proposal of creating new posts/making changes to details without changing the organisational structure of an agency. The study also does not change the activities/programmes in the establishment warrant.
  3. Establishment of a New Agency study refers to a study on increasing the number of agencies in the public sector. Any proposal to establish a new agency should be submitted to the Special Committee Meeting to Study the Top Management Posts (JKTT) chaired by YBhg. Chief Secretary to the Government of Malaysia.
3. What are the methods/principles used by the BPO in considering applications for changes in job grade and establishment strengthening?

Among the methods/principles used are:

Relativity and Parity Consideration on the establishment needs of the agency based on a comparison between its function and other/equivalent agencies.
Model Consideration on the establishment needs based on a uniform and complete structure that has been determined for a particular function.
Weightage Consideration on the establishment needs based on specific elements/criteria that are given values/weightage as a basis for decision-making.
Establishment Ratio Consideration on the establishment needs based on the ratio between the task load and the total posts required.
Establishment Norm Consideration on the establishment needs based on the standards used to determine the posts and organisational structure required according to the functions/roles specified for the agency.
4. What are the Differences between Premier Grade and Special Grade?

Both Premier Grade and Special Grade are in the Top Management Group but they can be differentiated according to the following roles:

  • Premier Grade – A designation that performs the function of management and policy formulation. Example: The Chief Secretary/Director General of a Ministry/Department.

  • Special Grade – A designation that assigns incumbents with expertise and experience in specific areas and does not play a role or perform management and strategic tasks. Example: Medical specialists in hospitals.
5. Why are “Open Posts” still required in public service?

Open Posts are established to allow a vacancy to be filled by personnel from any scheme of service with the required skills/expertise in performing the duties of the post. Open Posts cannot be used for the purpose of permanent appointment, promotion and job confirmation.

Schemes of Service

1. Definitions/Terminologies of the Service Groups currently in effect.
  1. Top Management: Premier Grade C to Head of Staff I;
  2. Managerial and Professional: Grade 41 to Grade 56;
  3. Support Group with Diploma/STPM Qualification: Grade 29 to Grade 40;
  4. Support Group with SPM Qualification: Grade 19 to Grade 28; and
  5. Support Group with PMR/SRP Qualification and below: Grade 11 to Grade 18.
2. Is there a Service Circular Letter or a Service Circular that should be referred to in determining the recognised credentials for appointment into public service?

The documents that can be referred to in determining the acceptable qualification for appointment into public service are as follows:

3. How do I check whether a qualification at the diploma or degree level is recognised for appointment into public service and how do I determine an equivalent qualification?

Starting from 1st January 2017, the role of qualification verification was carried out by the Malaysian Qualifications Agency (MQA). All programmes accredited by the MQA starting 1st January 2017 would indicate that they have been recognised by the Malaysian government.

Therefore, any recognised qualification for appointment into public service of Malaysia listed on the official website of e-Sisraf is until 31st December 2016 only.

Any review of the qualification recognition before 1st January 2017 should be referred to the official e-Sisraf portal at http://www2.mqa.gov.my/mqr/. Meanwhile, after 1st January 2017, the review of any qualification should be made through the official website of the Malaysian Qualification Register (MQR) at http://www2.mqa.gov.my/mqr/.

4. If I have a KPM Certificate of Matriculation, am I eligible to apply for employment with the Public Service Commission (SPA)?

Starting from the first students’ intake of Certificate of Matriculation in 1999/2000, the Certificate of Matriculation is eligible to be requested by students from KPM. For appointment into any appropriate position in public sector, only students who have graduated with KPM Certificate of Matriculation with cumulative grade point average (CGPA) of 2.00 and above and passed all core subjects are eligible to apply for any suitable position offered by the SPA, as listed in Service Circular Letter (SPP) No. 3 of 2016.

5. With my Certificate of Matriculation qualification, what are my starting grade and salary if I am accepted to serve in the public sector?

Based on Service Circular Letter No. 3 of 2016 (SPP 3/2016) issued by the PSD, the entry-level qualification for the holders of KPM Certificate of Matriculation qualification is fixed to Grade 29 in the related scheme of service. The list of the scheme of service/position that can be applied by the holders of Certificate of Matriculation is as listed in Appendix A, SPP 3/2016.

6. What are the scheme of service grades based on the qualification groups that are currently in effect?

The scheme of service grades according to qualification groups that are currently in effect are as follows:

7. How do I check the qualification fields for Level 2 and Level 3 of Malaysian Skills Certificate (SKM) according to the scheme of service for appointment into Public Service?

SKM qualification can be used to apply for a Grade 19 post according to the National Occupational Skills Standard (NOSS) which is suitable with the candidates’ qualification. The list of the fields for Level 2 and Level 3 of SKM that are aligned with the schemes of service is available on the EZ Scheme website at the link https://www.interactive.jpa.gov.my/ezskim/.

9. Can the Malaysian Vocational Certificate (SVM) qualification be used for appointment into public service?

Candidates with an SVM Certificate (beginning from 2012) in specific qualification fields can be considered for appointment to a Grade 19 post for the schemes of service that require an SVM qualification.

10. How do I check the qualification fields for the Malaysian Vocational Certificate (SVM) provided in related schemes of service for the purpose of appointment into public service?

The information on the list of SVM fields aligned with the schemes of service is available on the EZ Scheme website at https://www.interactive.jpa.gov.my/ezskim/.
